The government must protect the country's cultural identity


 

 "Contrary to the provisions of Hungary's Basic Law, the Court of Justice of the European Union has ruled that Hungary must allow migrants into its territory who have so far been obstructed by fences and Hungarian border guards," wrote Hungarian Prime Minister Viktor Orbán in the 15th essay from his series "Samizdat" (www.miniszterelnok.hu), submitted without editorial intervention.

Our border guards did not allow migrants to enter. Those who managed to enter illegally are not allowed to remain on Hungarian territory. Those who want to apply for asylum must apply outside Hungary.

 The Hungarian government addressed the Constitutional Court of Hungary with this question: What needs to be done now?

The Constitutional Court issued three rulings.

He reaffirmed that the government must protect our constitutional identity - even if it contradicts the ruling of the European Court of Justice.

It states that if the EU institutions do not effectively exercise shared competences, then the Hungarian authorities can exercise them.

He argues that the link between migration and human dignity must also be seen in terms of the country's historical population.

 This is a decision of historical significance.

It is not easy to read. At his heart is the human being and human dignity - something that is rare in today's Europe.

 In defending human dignity, international courts follow the same path as progressive European societies as a whole. They have uprooted the individual from his or her natural national, linguistic, cultural, family, and religious communities. They deny that belonging to such communities is part of one's identity and therefore an integral part of human dignity. They deny that this guarantees protection under fundamental rights. Today they see only people who are people without attributes: they can live anywhere, speak any language or pray to any god.

 Traditional communities have become completely defenseless: they are opposed not only by political progressiveness, but also by the law. Today, Europeans have no right to decide who they want to live with in their own country - even when mass immigration leads to the disintegration of traditional communities, which form the basis of their own identity as individuals. After all, in terms of fundamental rights, Europeans today have no right to their country, their language, their culture, their family and their God.

 The ruling of the Hungarian Constitutional Court opposes this. He takes the overturned human rights system and gets it back on its feet. It is in this light that we need to read what the decision says about the powers of the European Union and the sovereignty of Hungary. The Hungarian state is obliged to prevent serious violations of the identity of individuals - even if such violations come from a decision of the Court of Justice of the European Union or from shortcomings in the exercise of EU power. The traditional social environment of the people living in Hungary must not be allowed to change without a democratic mandate and state supervision.

 There is a homeland only where there are rights. And according to Hungary's Constitutional Court, Hungarians have the right to their own homeland.
