The EC has launched another lawsuit against Poland over the rule of law

 


 The European Commission (EC) has launched another lawsuit against Poland for violating European law by the country's Constitutional Court (CC) following the failure of all attempts at dialogue with Warsaw. This was stated at a press conference in Brussels by EU Commissioner for Justice Didier Rainders, Reuters reports.

"Today we launched proceedings against Poland for violating European law by the Constitutional Court. We have tried to establish a dialogue, but the situation is not improving, "the commissioner explained.

 According to him, Brussels has already sent a formal notification to the Polish authorities, who must respond within two months. The EC will then determine the next steps.

On December 20, 2017, for the first time in the history of the European Union, the European Commission launched a sanction procedure against Poland for violating the basic principle of the independence of the judiciary. This decision was prompted by the reform of the judicial system of the Polish authorities. The new rules have sparked a wave of protests in the country, as well as discontent in many European capitals, as well as EC investigations.

 The proceedings between Warsaw and Brussels have been going on for several years. On October 7, the Constitutional Court of Poland, after considering the request of the Prime Minister Mateusz Morawiecki, confirmed the inconsistency of the rule of domination of European law over the provisions of the Constitution of the Republic. This came after the European Court of Justice concluded that the reform of the Polish judiciary could violate EU law.
